Where a state permits surcharging, the network baseline applies. For auto dealers the added wrinkle is state surcharge-ban statutes that may or may not be enforceable: in California, § 1748.1 is nominally in force but its enforcement was enjoined by Italian Colors v. Becerra (9th Cir. 2018). Parts and service often differ from vehicle sales/leases, and lender contracts on financed deals can restrict fees.
The California wrinkle
California Civil Code § 1748.1 makes it unlawful to impose a surcharge for card use, but the Ninth Circuit’s Italian Colors v. Becerra (2018) enjoined enforcement of that ban. The practical result: dealers in CA typically use a cash-discount (dual-price) program to avoid the ambiguity. Other states have their own surcharge-ban statutes with varying enforceability — verify with the state AG.

- Confirm your state status in the matrix (note contested states like CA, TX, ME).
- Decide surcharge vs cash discount — a dual-price program avoids the § 1748.1 ambiguity in CA.
- If surcharging parts/service, submit the ~30-day acquirer notice and exclude debit cards.
- Check financed-deal lender contracts — some prohibit adding a fee to a vehicle sale or lease.
- Disclose the fee before the customer signs; keep it off any RISC (Retail Installment Sales Contract) lines where lender terms prohibit added fees.
