Where a percentage surcharge is permitted, the network baseline applies (3% Visa / 4% Mastercard cap, 30-day notice, no debit, disclosure, signage, receipt line). But most fuel retailers offset card costs with the dual-price cash discount at the pump, which federal law specifically protects and which is legal in every state.
The pump dual-price model
Federal law (15 U.S.C. § 1666f) protects a merchant who offers a genuine cash discount — including posting a lower cash price and a higher credit price at the dispenser. The two prices must be disclosed on the pump. This is the usual, low-risk way fuel retailers recover card costs, and it sidesteps the contested-state surcharge risk entirely.

Your fuel-retailer go-live checklist
- Confirm your state in the matrix if you plan a percentage surcharge (banned in CT, MA, PR; contested in CA, TX, ME).
- For the pump, post both prices (lower cash, higher card) on the dispenser per 15 U.S.C. § 1666f — no 30-day notice required for a true cash discount.
- If surcharging inside the store, submit the ~30-day acquirer notice and exclude debit cards.
- Ensure the dispenser and the in-store POS both disclose the price difference before payment.
- Print the surcharge (or the higher card price) as a separate receipt line.
- Run a live test at the pump and at the counter and read both receipts before going live.
