Salons & Barbershops Credit-Card Surcharge: State-by-State Compliance Checklist (2026)
A per-state landing checklist for salons and barbershops: the 52-jurisdiction matrix plus the go-live steps that fit tipping and booth-rent setups.
Last verified: 2026-09 · Educational reference, not legal advice
Where surcharging is permitted, the network baseline applies (3% Visa / 4% Mastercard cap, 30-day notice, no debit surcharge, disclosure, signage, receipt line). Cash-discount programs are very common in personal-services businesses because they avoid the contested-state risk.
The tipping rule
A surcharge must be calculated on the pre-tip service subtotal and shown as a separate line — never folded into or added on top of the gratuity. Train staff so a client is never charged a "fee on their tip."

Your salon go-live checklist
- Confirm your state in the matrix (surcharging is banned in CT, MA, PR; contested in CA, TX, ME).
- If surcharging, configure the POS to compute the fee on the pre-tip subtotal only.
- Exclude debit cards (run as credit or not) from any surcharge — federal Durbin rule.
- Post signage at the entrance and at the chair/register; print the surcharge as its own receipt line.
- Submit the ~30-day notice to your acquirer before going live.
- If in a banned or contested state, run a cash-discount program instead — legal everywhere.
Never surcharge the tip. Compute the fee on the pre-tip amount and keep it off the gratuity line. In CT, MA, and PR surcharging is banned outright — use a cash discount there.

Frequently asked questions
No. A surcharge applies only to the pre-tip service subtotal. The gratuity is separate and must not carry a card surcharge.
Each booth renter is generally their own merchant account, so the same state rule applies to whoever runs the card. Confirm who is the registered merchant of record.
Usually. Posting a higher card price and a lower cash price is legal in all 50 states + DC + PR and avoids the contested-state risk entirely.
