Restaurants & Bars Credit-Card Surcharge: State-by-State Compliance Checklist (2026)

Where surcharging is permitted, the network baseline applies (3% Visa / 4% Mastercard cap, 30-day notice, no debit, disclosure, signage, receipt line). Two restaurant-specific rules: (1) never surcharge the tip — compute the fee on the pre-tip subtotal; and (2) some states’ junk-fee laws affect how mandatory fees are shown on menus (California’s SB 478 exempts restaurants, so a clearly disclosed surcharge on the menu is generally allowed).
The no-tip-surcharge rule
A surcharge must be calculated on the pre-tip service subtotal and shown as a separate line — never folded into or added on top of the gratuity. Train servers so a guest is never charged a "fee on their tip." In CT, MA, and PR, surcharging is banned outright; a cash-discount program is the alternative there.

Your restaurant go-live checklist
- Confirm your state in the matrix (banned in CT, MA, PR; contested in CA, TX, ME).
- Configure the POS to compute the surcharge on the pre-tip subtotal only — never on the gratuity.
- Exclude debit cards (run as credit or not) from any surcharge — federal Durbin rule.
- Post signage at the entrance and on the menu/check presentment; print the surcharge as its own receipt line.
- Submit the ~30-day acquirer notice before going live.
- If in a banned/contested state, run a cash-discount program instead — legal everywhere.
